Southern Comfort Properties Inc. (“Southern Comfort�) owns the trade mark SOUTHERN COMFORT for use in association with cordials and liqueurs. Their product is widely advertised in the media. Recently, a digital image of a Southern Comfort billboard was altered to substitute the words “liquid panty remover� for the brand name although it was readily apparent that reference was being made to the Southern Comfort brand.
The image was widely reproduced across the internet on thousands of computers and posted at various comedy sites. Unfortunately for Southern Comfort, many people who saw the billboard thought it was real and they started to receive postcards, letters, phone calls and e-mails. The image also came to the attention of the publisher of a feminist magazine who chose to publish the image together with the email and fax number for the head of public relations of Southern Comfort. The result was a torrent of complaints from women across the country many of whom called for a boycott of Southern Comfort.
The prospect of such events occurring makes brand management more difficult than ever. Brand owners must carefully monitor the internet and develop appropriate strategies for dealing with situations like this one.
